For Wine Club Shipments and Wine Shipments
By checking the boxes below, you are indicating that you have read and understand the following terms:
All wines purchased from Farmstead Cheeses and Wines (heretofore "Farmstead") are deemed sold in California and title passes to the buyer in California. We make no representation as to the legal rights of anyone to ship or import wines into any state outside California. The buyer is solely responsible for the shipment of wines. By placing an order, you authorize us to act on your behalf to engage a common carrier to deliver your order to you.
You must be at least 21 years of age to order or receive wine shipments from Farmstead. You represent to Farmstead that you are at least 21 years of age and the person to whom delivery will be made is at least 21 years of age.Shipments containing alcoholic beverages are sent with an "Adult Signature Required" notice. Any shipment containing an alcohol beverage will require the signature of an adult possessing valid picture identification issued by a government agency proving he or she is at least 21 years old. In the event that an Adult is not available to sign for the shipment, the purchaser or recipient may ultimately be responsible for additional charges if the undeliverable items have to be reshipped. We strongly recommend shipping to a business address whenever possible to facilitate delivery.
Title to and ownership of wine purchased from this website or from Farmstead Cheeses and Wines LLC passes from Farmstead Cheeses and Wines LLC to the purchaser in the State of California. The risk of loss for all purchased items also passes from Farmstead Cheeses and Wines LLC to the purchaser in the same manner and at the same time title passes to the purchaser.
Farmstead Cheeses and Wines LLC does not convey or intimate the right of any person to transport beverage alcohol across any state border. The purchaser takes all responsibility for the shipping of his or her wine from California to his or her home state. At the purchaser’s request, Farmstead Cheeses and Wines LLC will arrange delivery of the wine. In doing so, Farmstead Cheeses and Wines LLC is providing a service to and acting on behalf of the purchaser. By utilizing this service, the purchaser represents that he or she is acting in a manner compliant with his or her state and local laws regarding the purchase, transport and delivery of wine.
The purchaser represents that he or she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine, is legally entitled to take quantities ordered, and certifies that he or she is at least 21 years of age. Farmstead Cheeses and Wines LLC reserves the right to choose any and all procedures, packaging and transporter of sold merchandise. Farmstead Cheeses and Wines LLC assumes no liability for breach of any regulation by the purchaser. Farmstead Cheeses and Wines LLC assumes no liability for any misinterpretation of the above provisions.
We ship wine via GSO (CA and urban AZ and NV) and UPS Monday through Friday. During periods of extreme weather, we reserve the right to withhold shipments to avoid potential damage.
We aim to process and ship all orders as quickly as possible. The majority of orders will be processed within 24-48 hours of being placed.
Extreme temperatures can adversely affect wine and because we have no control over the conditions of a carrier's warehouse facility, orders received in the later part of the week generally will not be shipped until the beginning of the following week to ensure the best possible conditions.
High temperatures may cause your wine to leak or extreme cold temperatures can freeze your wine during shipment. Farmstead Cheeses and Wines is not responsible for, and will not replace, wine that is damaged by extreme weather conditions. By placing an order you are accepting the responsibility for your wine shipment through whatever weather conditions may occur during that shipment.
Incomplete or inaccurate billing or shipping information will result in a delay in processing.
You may cancel your subscription at any time. You will receive an email confirming your subscription to the Wine Club. At the end of each month, we will alert you via email when your club package is ready to be picked up at the shop of your choice or if you are having the package shipped, when it will be sent to you. If you will be away from your shipping address and cannot receive a shipment, please contact us and we will hold the wine until it can be shipped to you or we can put your membership on hold until you are ready to start receiving shipments again.
